Michigan Bar Road Motorcycle Accident Occurs in Collision With ATV
A motorcycle accident that involved crashing with an all-terrain vehicle (ATV) occurred near Rancho Murieta on May 20, resulting in a major injury. The crash happened along Michigan Bar Road south of Labrobe Road around 10:49 p.m. in the roadway. One person, identified only as a 28-year-old male, was airlifted to UC Davis Medical Center for care, according to the California Highway Patrol (CHP).
Authorities Determining the Cause of the Motorcycle Crash
So far, the injured man is a John Doe, which means the identity is unknown. CHP traffic investigators are at work to determine how the collision occurred and which rider was at fault.
Operating an All-Terrain Vehicle in California
In California, operating an ATV on the roadway is illegal because they are designed for off-road use. However, they are allowed on fire roads and park trails. An ATV may enter the roadway only under the following conditions:
- At marked off-highway vehicle (OHV) crossings when the street is over two lanes wide
- When the rider is crossing a road with two lanes
- Designated OHV streets with stoplights during daylight hours
Injuries When a Motorcycle Collides With an ATV on the Roadway
When a motorcycle collides with an ATV on the roadway, the potential for traumatic injury is high. Passengers and drivers of both vehicles can be seriously injured due to the difference in size and weight between a motorcycle and an ATV. Motorcyclists are particularly vulnerable because they lack protection from other vehicles on the road.
The most common injuries include broken bones, head trauma, spinal cord injuries, internal bleeding, and even death in extreme cases. Other less serious but still painful injuries that can occur include cuts, abrasions, bruises, nerve damage, cervical strain or sprain, and dislocations.
How a Lawyer Assists in Recovering Compensation
The attorney will work hard to collect evidence related to the motorcycle accident, including gathering and reviewing police reports, interviewing witnesses, obtaining medical records, or consulting with expert witnesses if necessary. Additionally, a lawyer can help the client build their case by preparing legal documents such as pleadings and discovery requests in court proceedings. By doing so, the attorney can determine who was at fault for the accident and calculate how much compensation should be recovered.
Negotiations to Reach a Settlement
In some cases, lawyers may attempt to negotiate a settlement with insurance companies before filing a lawsuit. These negotiations are often successful. If successful, this can result in faster recovery of compensatory damages. On the other hand, if negotiations are not successful, personal injury attorneys typically proceed with filing suit in civil court to seek relief through trial.
