Personal Injury Laws in California
A variety of accidents occur every day throughout California. When a person has been injured after an accident through no fault of their own, they may be entitled to financial compensation for the injuries and losses they have suffered. Personal injury law covers many types of situations in which an individual is hurt by the negligence or wrongdoing of someone else. Some common examples of such accidents include motor vehicle collisions, road defects, and poorly designed or manufactured vehicles. In California, these types of cases must be filed within the two-year statute of limitations. If the filing deadline is not met, the case may be dismissed by the court, and the injured individual may be barred from seeking personal injury compensation.
Filing a Claim for Injuries and Damages After a Merced Crash
A driver who causes injury to another party due to their negligence behind the wheel of a motor vehicle may be held financially accountable through a personal injury claim. This may be done if it can be proven that the at-fault party caused the accident as a result of failure to exercise due care, their breach of duty owed to the injured person, their wrongdoing was a direct cause of the injuries, and damages incurred as a result. These types of cases are generally brought against insurance companies representing negligent drivers. In situations where the at-fault party has state minimum car insurance coverage or none at all, the injured individual may seek recourse through their uninsured/underinsured motorist coverage (UM/UIM). UM coverage comes into play when it has been proven that the driver has no insurance through evidence like an SR-19C form filed with the DMV. UIM coverage may be used if the damages exceed the at-fault party’s policy limits. To learn more about UM coverage in an auto accident and how it can help you, watch the video below.
