Who is at Fault in a Chain Reaction Accident?
People injured in car accidents are often able to recover compensation for their injuries and losses through a personal injury claim. Such cases are often complex to handle when a crash involves more than two vehicles. Before recovery for the personal injury claims process starts, negligence must be proven on the part of the at-fault party. When there are multiple cars and motorists involved, deciding who is at fault for the auto accident can be even more challenging. Investigations by police and insurance companies often follow most chain reaction accidents. This may add another layer of difficulties to any personal injury case. However, an experienced Stockton car accident lawyer can help those injured by conducting an independent investigation of the collision, determine who was at fault and obtain fair compensation for their damages.
How Do You Prove Fault in a Car Accident?
Building a successful personal injury case for a traffic collision generally requires evidence to support an allegation of liability. To recover compensation from the at-fault party and their insurance company, an injured person must establish that the other motorist’s conduct failed to meet a standard of reasonable care. In the context of a collision, this breach of duty may be demonstrated through speeding, driving under the influence, or texting while driving. If the injured party can prove that the at-fault party breached their duty through negligence, they must next demonstrate that this breach was the direct cause of their injuries and losses. Evidence to support fault includes photographs of the accident scene, visible injuries, and property damage, police reports, and witness statements. Medical records, expert witness testimony, and income statements before and after the crash are also necessary for proving damages. Recoverable Damages in an Auto Accident Claim
Once negligence has been established, a person injured in a car accident may be able to claim a wide array of damages, and an experienced Stockton personal injury can help with that. Concrete losses such as medical bills, wage loss, and property damage are generally included in an economic damage assessment. Intangible losses like loss of enjoyment of life, loss of consortium, and pain and suffering are also available for recovery but are more challenging to prove and calculate. Evidence that an injured party may use to show their damages include costs of medical treatment, projections of long-term care expenses, receipts for vehicle repairs, and records of wage loss.
Do You Need a Lawyer for a Stockton Minor Injury Crash?
When you are involved in a car accident and only filed a property damage claim as a result, then you will most likely not need to hire a Stockton personal injury lawyer. If you suffered injuries, no matter how minor they seem at the time of the crash, you may want to hire an injury attorney to handle your claim. Symptoms of some traumatic injuries may not present themselves immediately after a collision, like a traumatic brain injury or a spinal cord injury. That is why it is essential to seek medical treatment after a crash to ensure you are not severely injured.
