Modesto Man Killed in Benicia Hit and Run Accident
A 56-year-old man from Modesto was killed in a Benicia hit and run accident on the evening of October 21, 2019. The pedestrian accident occurred along Interstate 780 in the vicinity of the State Park Road overpass in Benicia around 7:40 p.m. According to the California Highway Patrol (CHP), a man was hit by a 2013-2018 silver Honda Accord. The driver of the Honda reportedly left the scene following the collision. Sadly, he succumbed to his injuries at the scene. His identity has been withheld by the Solano County Coroner’s Office until his family has been notified.
Wrongful Death in a Benicia Hit and Run Accident
When a loved one is lost in a hit and run accident, this may leave surviving family members in a financial predicament. In such cases, a family may be able to file a claim under a deceased loved one’s auto insurance policy if they carry Underinsured Motorist Coverage. This helps cover wrongful death damages incurred in a hit and run accident until the suspect driver has been located. If the suspect is later identified and carries little to no insurance, the family may be able to file a claim under the decedent’s Underinsured Motorist Coverage. Conversely, if the decedent did not have car insurance but lived with someone who does, a claim may also be brought under that coverage. What Can Be Recovered in a Wrongful Death Claim?
Many financial and intangible losses may result from the wrongful death of a loved one. Depending on the relationship with the deceased, specific family members may be able to claim one or more of the following economic and non-economic damages:
- Costs of a loved one’s funeral and burial
- Loss of the decedent’s protection, care, love, and companionship
- Loss of parental instruction and guidance for surviving children
- Lost financial support and household services, which may be assessed by an economist
- Medical expenses for treatment received by the deceased before he or she passed away (these are recoverable through a survival action)
Understanding the wrongful death claims process may be challenging, even more so when coming to terms with the loss of someone you love. For a breakdown of these types of cases, watch the below video.
