What to Do if a Loved One is Killed in a Ceres Car Accident
The loss of a loved one in an auto accident is devastating, particularly when they were taken from us due to the careless or negligent act of another. This may compound the grief and sorrow surviving family members are experiencing with emotions of anger and disbelief. Such tragic events may also cause physical symptoms, such as anxiety and lack of sleep. When undergoing the grieving process, it is essential to make sure you are fulfilling your basic needs.
What are the types of Damage in a wrongful death claim?
Following a fatal car accident, the family of the decedent may have the grounds to file a wrongful death claim to hold the negligent driver financially responsible for their loved one’s death. Recovery through these types of cases is intended to compensate surviving family members for the financial and intangible damages they have suffered, such as:
- Costs of a funeral and burial
- Loss of future financial support and benefits, such as medical insurance and pension
- Loss of parental guidance and training
- Lost contributions to relatives, including love, companionship, affection, and moral support
- Medical expenses for treatment received by the deceased before he or she died (recoverable through a survival action)
- Punitive damages may be recovered if the wrongful death car accident was caused by egregious misconduct, such as driving while intoxicated or excessive speeding.

Who Can Bring a Wrongful Death Claim in California?
Relatives who are allowed to obtain compensation in California are often referred to as survivors and may include a spouse, domestic partner, or child. This is by the California Code of Civil Procedure Section 377.60. If there is no living child or spouse, then the deceased’s parents, putative spouse, or stepchildren may file a claim. Conversely, any minor who was dependent on the decedent for financial support may also be eligible for wrongful death damages.
How Can a Lawyer Help Our Family?
After a wrongful death car accident, it is essential to work with an experienced Modesto wrongful death attorney. An attorney can help investigate the events leading up to the crash and relevant evidence on a family’s behalf. This includes traffic collision reports, eyewitness accounts of the crash, video surveillance, and testimony from accident reconstruction experts. This way, the lawyer can prepare a solid case to prove the other driver was responsible for their loved one’s death.
