What Types of Losses are Recoverable in Wrongful Death Cases?
Eligible survivors in a wrongful death action may seek compensation for their intangible and financial losses. These are also known as economic and non-economic damages. Economic damages are intended to provide compensation for losses that are financial in nature and quantifiable. They may include lost earnings and other income, funeral and burial bills, final medical treatment costs (this may be sought for reimbursement in a survival action), and other financial losses. Non-economic damages are subjective which means that they differ from case to case. They are meant to compensate claimants for intangible harm like mental anguish and loss of companionship.
The amount and type of compensation awarded to surviving family members in a wrongful death claim will depend on the facts and circumstances surrounding the matter. The best way to determine your eligibility for a wrongful death claim and the types of damages you may seek is to consult with an experienced accident attorney in your area. Having legal counsel on your side after a fatal accident may streamline the recovery process and ensure that all aspects of the case are met accordingly. Not only do attorneys ensure that paperwork is filed appropriately, and legal deadlines are followed, but they may also provide support and guidance through this trying time.
