Losing Someone You Love in a Commercial Truck Accident
The unexpected loss of a close relative in a big rig crash is painful and devastating for the family left behind to pick up the pieces. Such a loss may leave survivors financially insecure and emotionally distraught. If the incident was the result of someone else’s negligence, surviving family members may hold the other side liable for the undue harm they have suffered through a wrongful death claim. This type of case is intended to provide surviving family members with the compensation they need to make them whole again. It is divided into two types, economic damages and non-economic damages. Under the California Code of Civil Procedure Section 335.1, the surviving spouse, domestic partner, and children of the deceased have priority when it comes to seeking financial compensation for damages incurred. Other relatives may be eligible for filing if such relationships with the decedent are non-existent.
Recoverable damages may include costs of medical treatment related to the final injury suffered in the semi-truck collision, funeral costs, loss of companionship, mental anguish, loss of future earnings, and more. Putting a price on a loved one’s life may seem strange. However, wrongful death matters deal with the financial losses and intangible harms that surviving family members have endured and are intended to provide them with essential compensation. Favorable resolutions in these cases may also provide survivors with a sense of closure and justice, knowing that the negligent party has been held accountable for their conduct. Accomplishing this may be challenging, but the right truck accident lawyer in Modesto may simplify the process.
