Wrongful Death Claims for Fatal Crashes in California
The loss of a close relative is never easy for the family left behind to accept and come to terms with. This is especially true if the death occurred because of a preventable car accident. When this happens, surviving family members may seek compensation and justice for their loss through a wrongful death claim. While no amount of money can undo the devastation and grief resulting from the unexpected loss of a loved one, compensation from a wrongful death case may help survivors build a more secure future.
A wrongful death case is comprised of two types of damages: economic and non-economic. Economic damages reflect financial losses, whereas non-economic consider intangible ones. Survivors may be compensated for the costs of medical treatment leading up to a close relative’s death as well as expenses for funeral services. They may also seek damages for the loss of a loved one’s care, support, and companionship. If surviving family members were dependent on the deceased individual for financial support, they may bring a claim for loss of future earnings. Aside from non-economic and economic damages, survivors may seek punitive damages from the at-fault party as a way of punishing them for egregious conduct.
As with any case, there is a statute of limitations that must be met. If a lawsuit is not filed within the two-year deadline, as outlined in the California Code of Civil Procedure Section 335.1, the court may dismiss the case and survivors cannot recover damages. If your family is considering taking legal action against those responsible for your loss, do not delay. What Survivors Should Know About Fatal Single-Vehicle Crashes
In some wrongful death claims for fatal car accidents, the insurance company representing the other party may contact surviving family members and attempt to give them a quick settlement offer. With expenses mounting, survivors may be persuaded into accepting it. However, it is essential for families to understand that initial settlement offers are offered in hopes of them accepting without realizing the true extent of their losses. For this reason, it is essential to work with a lawyer who has experience in handling wrongful death matters.
