Modesto Man Seriously Injured in Motorcycle Crash

A 25-year-old man from Modesto was seriously injured in a crash involving a vehicle and his motorcycle on the evening of Monday, November 30, 2020. The motorcycle accident in Modesto occurred on Scenic Drive and Rose Avenue shortly before 6:25 p.m. A spokeswoman for the Modesto Police Department (Modesto PD) said the incident involved a driver of a Honda Civic and a motorcycle rider.

Officials said a 25-year-old Modesto man was riding a motorcycle westbound on Scenic Drive when the Honda driver, a 31-year-old Modesto resident, entered his path while attempting to make a left-hand turn onto Rose Avenue. The Honda driver sustained minor injuries while the motorcyclist suffered serious injuries in the wreck. The biker is expected to survive, the Modesto PD reported. Further details on the Modesto motorcycle crash were not immediately available.

Top Causes of Motorcycle Accidents Involving Vehicles

A motorcycle wreck may occur for many reasons, including:

  • Drunk Driving: A motorist driving while under the influence of alcohol or drugs may experience drowsy driving, slowed reaction times, or even fall asleep at the wheel. All these behaviors are dangerous and may endanger the lives of others on the road, including bikers.
  • Speeding: When drivers in Modesto exceed the posted speed limit, they may experience challenges while reacting to traffic and weather conditions. This may be dangerous, particularly when there are motorcycle riders nearby. Because motorcycles are small vehicles in terms of stature and size, they may be challenging to spot regardless of clear and ideal conditions. When a driver is traveling above the speed limit, there is a far greater risk that they may not see the motorcycle rider until it is too late.
  • Reckless Driving: A driver who operates a vehicle recklessly or carelessly is one that is considered showing willful and wanton disregard for the safety of others on the road. Some examples of reckless driving include running stoplights or traffic signs, weaving in and out of traffic, and tailgating. Drivers of passenger vehicles who display this type of behavior may put motorcycle riders at significant risk of injury or death.

Types of Personal Injury Compensation in a Motorcycle Accident Case

When a biker is hurt in a motorcycle crash through no fault of their own, they may be entitled to compensatory damages for their injuries and losses incurred. Damages in a personal injury claim for a motorcycle accident may come in three types:

  • Economic Damages: In a motorcycle accident injury case, economic damages are quantifiable losses. These include the cost to repair or replace a motorcycle damaged in the wreck, medical expenses, lost income, loss of future earnings (in the case of a permanent injury or disability, and wrongful death damages (in the case of a loved one’s wrongful death).
  • Non-Economic Damages: Intangible losses in a motorcycle accident injury case like loss of consortium, lost enjoyment of life, and pain and suffering are challenging to assign a dollar figure to. This is because non-economic damages are subjective in nature and differ in value from case to case.
  • Punitive Damages: In some extreme cases in which the actions of the at-fault party were particularly egregious, the Modesto motorcycle accident lawyer representing the injured biker may seek punitive damages from the wrongdoer. These are intended to deter the negligent party and others from engaging in similar behaviors in the future.
