How Can a Wrongful Death Claim Help Our Family?

When a loss of life occurs in an accident caused by the negligence of another party or entity, it may be considered wrongful death under California law. This means that a loved one’s life was taken away due to negligent actions and that it could have been prevented altogether had reasonable care been exercised. In such heartbreaking situations, families of decedents may take legal action against the at-fault party in the form of a wrongful death claim. These types of cases arising from fatal motorcycle accidents are generally brought against the negligent driver and their insurance company. They are intended to make surviving family members whole again through the form of financial compensation for the financial and intangible losses they have suffered.

California law is specific on which survivors may be entitled to benefits through a wrongful death action and which ones have priority when it comes to bringing such cases forward. The surviving spouse, domestic partner, or children of the decedent may file for the wrongful death of a family member. This is by the California Code of Civil Procedure Section 377.60. Other family members may bring a wrongful death action forward if no surviving spouse, domestic partner, or children exist. This may include the deceased person’s parents, putative spouse, stepchildren, and putative spouse’s children. If you are unsure on whether you may be eligible to file a wrongful death claim, discuss your case with an experienced accident attorney. How Much Time Do You Have to File a Wrongful Death Claim?

When a family loses a loved one in a motorcycle accident caused by someone else’s negligence, it is essential to speak with a skilled lawyer right away to have the facts and circumstances of the case reviewed. Keep in mind that a two-year statute of limitations generally applies to wrongful death lawsuits, as outlined in the California Code of Civil Procedure Section 335.1. It is essential to also note that the statute of limitations may be shortened to as little as six months if an at-fault party is a government entity. Retaining legal counsel immediately may make all the difference in the outcome of a wrongful death case.
