Motorcycle Injury Accidents Occur for a Number of Reasons
Motorcyclists are vulnerable to serious injuries when they are involved in an accident. A motorcycle collision often occurs for the following reasons:
Drivers of other vehicles are often responsible for a motorcycle accident due to their negligence. Common types of negligence include excess speed, drunk or distracted driving or fatigue.
- In California, lane-splitting can lead to a motorcycle accident if the rider is attempting this maneuver when traffic is going too fast, or the rider becomes sandwiched between two vehicles.
- Defective parts in a motorcycle can cause a collision if the brakes malfunction, steering fails or engine stops as well as other reasons. Keeping the crashed bike afterward is necessary so it can be checked for defects. If found, the injured rider can place a product liability claim against the part supplier, manufacturer and others.
- Dangerous roadways can lead to an accident due to improper maintenance. Poor lighting, potholes, upheavals and fissures in the road as well as debris or objects can cause a serious motorcycle collision. The government entity in charge can be liable, but the limit to file this type of claim is six months. Filing later than that means the court will not hear the case, so getting help from an injury lawyer can make a difference.
Placing an Injury Claim Following a Motorcycle Crash
Those injured in motorcycle accidents may be entitled to damages. Damages may include:
- Medical expenses that arise because of the accident, including future costs if the trauma is ongoing
- Wages lost because the injured party couldn’t work as well as job benefits
- Pain and suffering, including psychological and physical trauma
- Punitive damages may be awarded if the accident injury was intentional or especially egregious
