Can You Bring a Personal Injury Claim for a Motorcycle Crash?

A motorcycle accident may have devastating consequences for the operator and passenger. That is because motorcyclists do not have the same protection and safety features that a car would provide its occupants. When a biker has suffered injuries in a crash caused by another driver or entity, they may have grounds for a bodily injury claim against the other side. To bring a successful injury case forward, it must be proven through clear and compelling evidence that the at-fault party had a duty to exercise due care and breached that duty, causation, and resulting damages. Some common reasons for motorcycle crashes caused by drivers may include drunk driving, failure to yield the right-of-way to bikers, distracted driving, speeding, and more.

If a timely claim is filed and liability is established through substantial evidence, the injured party may recover economic and non-economic damages from the other side. This may include medical bills, wage loss, pain and suffering, and other losses related to the motorcycle accident. Remember that a two-year statute of limitations generally applies to personal injury cases arising from accidents. This deadline may be shortened to six months in cases involving public agencies. This is by the California Government Code Section 911.2. Therefore, it is essential to discuss your case with a skilled Brentwood personal injury lawyer to learn about your rights as a claimant and the time limits applicable to your claim. Is it Worth Hiring a Lawyer for a Motorcycle Accident Injury Case?

Given the great potential for traumatic injuries or even death from motorcycle accidents, it is without a doubt that the stakes are high. Insurance companies are well aware of this and will not hesitate to resort to defense tactics to get out of paying fair compensation to a motorcyclist injured by their insured’s negligence. The same approach may apply to an uninsured or underinsured motorist claim that an injured motorcyclist files against their insurance policy.
