How is Negligence Proven in a Motorcycle Accident?
There is a wide array of reasons why motorcycle accidents occur, and most of them are often the result of driver error. One of the leading causes of motor vehicle collisions involving motorcycle riders is drivers not yielding the right-of-way, speeding, not checking their blind spots, and other forms of careless driving. Such situations may lead to serious injuries or even death due to a biker’s lack of physical protection against a motor vehicle and falling onto the pavement.
If a driver has been found at fault for a fatal motorcycle accident, they may be held accountable for the losses of surviving family members. These may be in the form of economic and non-economic damages, like loss of companionship, funeral costs, loss of future financial support, and more. This may be accomplished through filing a wrongful death claim against an at-fault party and their insurance company. To bring a successful case forward, there must be clear evidence demonstrating negligence on the part of the other side.
