Loss of a Loved One
The loss of a family member may be a devastating experience. It may wreak immense havoc on the psychological, emotional, and physical well-being of surviving family members. The loss may also lead to financial hardship, leaving survivors with significant challenges moving forward.
When the loss was caused by the negligent acts of another, the family of the decedent may be able to bring a wrongful death claim against the person or entity responsible for the fatal crash. Damages recoverable may include medical bills associated with the final injury, funeral service costs, projected value of future financial losses, and the loss of companionship, services, and support. Aside from financial and intangible losses, punitive damages may be sought from the negligent party to punish and discourage them from engaging in similar conduct in the future. These are generally awarded at the court’s discretion.
Recovering compensation in wrongful death cases is not a straightforward process as it is circumstantial and based on various facts. Working with an attorney is essential as they may explain to surviving family members the laws and deadlines that apply in their case. Importance of Hiring an Attorney After a Motorcycle Accident
In California, families of decedents have up to two years from the date of a fatal motorcycle crash to bring a lawsuit in civil court. If survivors do not file within the time frame, the court may dismiss the case, and they may lose the right to recovery of wrongful death damages. Retaining a lawyer may be helpful to surviving family members as there may be evidence and time-sensitive documents that must be secured and handled immediately after a crash. Working with a wrongful death lawyer has various benefits and may allow you and your family to focus on recovering while the attorney works on recovering the full and fair compensation you all deserve.
