Motorcycle Crashes and the Loss of a Loved One

As a family member of a motorcycle rider, it is natural to worry about the risks he/she faces on the road. They want to know what happened after they find out that their loved one passed away in an accident. At AutoAccident.com, our investigators and legal team share the same opinion. Gathering facts and evidence before it is destroyed or covered over is important so that family members have the answers they are seeking.

It is because of this that we do not just wait for an official description of the accident. Our internal investigators examine the cause of the accident and determine liability. Using nearby surveillance cameras, we obtain video clips of the accident and search the area for information. We employ accident reconstruction techniques to identify the exact location of the vehicles before, during and after the motorcyclist fatality accident and talk to witnesses. Our legal team uses the findings from this work to build a robust case against the at-fault party.

Dangers That Motorcycle Riders Face on the Road

Riders are at risk of serious injuries or becoming a fatality in crashes despite their efforts to stay safe. The most common motorcycle accident causes include:

  • The most common cause of a motorcycle accident is a driver who makes a turn in front of the rider.
  • Drivers who are distracted by texting, talking on a cell phone, adjusting a radio or anything else can cause an accident.
  • Motorcycle accidents can be caused by impaired drivers. They are incapable of maintaining their lane, unable to see what cars are close to them, and have slowed reflexes, which significantly affect their ability to stop in the event of an emergency.
  • Motorcycle accident fatalities are often caused by speeding motorists. The long stopping distances needed by speeders can cause them to lose control of their cars and put everyone on the road in danger.
  • A motorcyclist fatality can be caused by poorly maintained roads. There are many ways that government maintenance could result in motorcycle accidents, including potholes, pavement disruptions, inadequate lighting, etc. It is possible to sue these entities for the damages they caused. However, the timeline to file is much shorter. The party who was injured or family filing a wrongful death claim has six months to file against a government entity. The government entity has up to 45 days to respond. If they deny the claim, the family has six months to file a lawsuit. If no response at all is received, they have up to two years to file the lawsuit.
  • A motorcyclist accident resulting in a fatality can be caused by defective parts. In order to find defects in the vehicle, it is important to retain it. By filing a product liability claim, the manufacturer can be held liable if it is found to have caused the accident.
