Eligibility to File a Case of Wrongful Death in California

In the California Code of Civil Procedure Section 377.60, the surviving family members of the decedent may be qualified applicants for filing a wrongful death action against the individual or entity responsible for the loss of life. This section outlines which survivors have priority to file, including the children, domestic partner, or spouse. If no children, domestic partner, or spouse exist, this does not necessarily mean that a case cannot be brought forward. Other relatives may be qualified applicants based on the circumstances and facts of the matter.

It is essential to enlist the services of a California wrongful death attorney right away to ensure that the appropriate steps in a claim for damages are followed promptly. The statute of limitations in California generally provides survivors with a maximum of two years to file in civil court. Furthermore, the deadline may be decreased in matters that name public entities as defendants. Under the California Government Code Section 911.2, the two-year time limit is shorted to 180 days from the date of loss. Filing is necessary to protect the statute if the case is not settled with the other party.

The compensation awarded for wrongful death may include non-economic and economic damages. These include the mental anguish that surviving family members may be experiencing, lost earnings the decedent would have brought into the family household, funeral service costs, medical costs before the deceased succumbed to final injuries, loss of companionship, and more.
