Who Can Bring a Wrongful Death Case in California?
In California, a wrongful death claim may be filed against an individual or entity whose recklessness or negligence resulted in a loss of life. This type of case would have to show that the at-fault party, through their negligent actions, demonstrated a disregard for the safety of the loved one. That behavior was the cause of the wrongful death motorcycle accident. In California, specific surviving family members of the decedent may bring a wrongful death case. Those eligible to claim monetary damages are:
- Spouse, domestic partner, or children
- Parents, stepchildren, putative spouse, or children of the putative spouse if there is no child or spouse
- Minors who were dependent on the decedent for financial support

What Can Be Recovered in a Wrongful Death Claim?
After losing a loved one in a fatal motorcycle accident, finances may be the last thing on a family’s mind when dealing with grief. As survivors look into the future, a wrongful death claim against the at-fault party is what they need to have the financial support and peace of mind, they need to move forward. A family may receive financial compensation for economic and non-economic damages, such as:
- Any costs a family has had to pay for a lost loved one’s medical treatment after the motorcycle accident that ultimately claimed their life (this may be recovered through a survival action)
- Loss of a family member’s care, love, and protection
- Lost future financial support the family has experienced as a result of the wrongful death motorcycle accident
