Types of Personal Injury Compensation for an Auto Accident Case

Compensation in a personal injury claim for a car accident will depend on various issues such as the facts and circumstances of the case, a wide array of legal matters, and the amount of bodily injury liability coverage available to pay a settlement. Some of the types of economic and non-economic damages an injured party may be entitled to after a car accident in Stockton include the following:

  • Payment of all accident-related medical expenses, including costs of future reasonable and necessary treatments
  • Lost income and loss of future earnings because of temporary or permanent injuries sustained in the incident
  • Pain and suffering for the emotional trauma and physical pain caused by injuries suffered in a crash
  • Property damage for personal property damaged in a collision

If the crash has resulted from another driver’s egregious conduct, the claimant may seek punitive damages from that individual. These are solely intended to punish the negligent party and deter similar behavior from them in the future. Benefits of Working with an Experienced Attorney

Here are some of the ways an attorney can help you get your life back on track after an auto accident:

  • Order traffic incident reports from local law enforcement and medical records for accident-related treatment visits.
  • Conduct an independent and thorough investigation of the motor vehicle collision to properly determine fault and identify all at-fault parties. This may include third parties such as the government entity responsible for the upkeep and design of the public roadway, employer of a negligent driver, or the manufacturer of faulty vehicle equipment.
  • Handle all communications and settlement negotiations with insurance claims adjusters and defense counsel on your behalf.
  • Determine all potential sources of financial recovery through auto insurance policies, such as uninsured and underinsured motorist coverage (UM / UIM) and Medical Payments (MedPay).
  • Work with a wide array of experts in the field, such as economists, medical professionals, and accident reconstruction experts, to prove the cause of the incident, the extent of financial losses, the severity of injuries, and other crucial matters.
  • Ensure all filing criteria and deadlines are met, particularly the two-year statute of limitations for filing personal injury lawsuits in civil court.
  • Prepare a strong case to present in trial in San Joaquin County if the insurance company fails to make a reasonable settlement offer.
