Napa Mother Awarded Damages

I’m Ed Smith, a Napa car accident lawyer. A jury recently awarded a Napa mother over $8 Million in damages that she and her young son received as the result of an auto accident with a street sweeper that occurred in mid-April 2015 during which her vehicle caught fire and she suffered severe injury.

Trial Details

The jury gave their judgment at about noon on Wednesday, February 1, 2017, after a day’s deliberation at the end of a civil trial brought against the employer of the street sweeper, Syar Industries. The trial lasted almost a month.

The plaintiff needed multiple surgeries and had to quit her job as a Napa County Probation officer after becoming traumatically injured as a result of the wreck.

Accident Information

The plaintiff, who is now 35-years old, had been driving her vehicle north on Highway 221 close to the Syar Industries exit at about noon on April 17, 2015. That is when a 59-year-old man operating a street sweeper performed a U-turn and collided with Alvarez’s car. This caused the car to catch fire and eventually be entirely consumed by flames. The California Highway Patrol (CHP) reported that the plaintiff’s then 3-year-old son was inside the car during the accident.

Thankfully, the plaintiff’s child did not receive any serious injuries. The plaintiff, however, suffered injuries to her right ankle, right knee, right leg, and ribs. Doctors expect that for her to recover, she will need surgeries in addition to the ones she has already undergone, including a full knee replacement surgery.

Attorney’s Statement

The plaintiff’s lawyer noted that the verdict was remarkable and demonstrated deep empathy and understanding for fellow community members on the part of the citizens of Napa. He also noted that his client will never be in the same physical condition she had been in before the accident and that while the money she received can not totally erase her loss, it will certainly help her family to recover.

Syar Industries’ legal representation could not be reached for inquiries regarding the case.

Value of Injury Claims

There is no precise formula that can produce an accurate amount for how much any personal injury case will be worth. However, juries, insurance companies, and attorneys consider a variety of factors in order to decide the value of claims. These factors include taking into account the cost of medical bills, the impact of an injury on a claimant’s life, whether the injury is permanent, whether the injury will require future medical treatment, what wages have been lost as a result of the injury, how the injury has affected personal relationships, and the severity of the injury itself. After taking these and other important factors into consideration, the value of an injury claim is meant to reflect the fair amount that a claimant is owed for the damages they have received.
