Details on the Farm Tractor Accident That Claimed the Life of a Newman Man
According to the California Highway Patrol (CHP), the collision occurred in the area of Eastin Road just south of Highway 33. A man was driving a John Deere tractor on Eastin Road. He was towing a sprayer tank when his tractor was reportedly rear-ended by the Chevrolet driven by a 24-year-old man.
The impact of the collision propelled the Chevrolet off the road and into a field along the eastern side of Eastin Road. The tractor went off the roadway, overturned, and collided with a power pole. The tractor driver was ejected from the tractor and landed on the road. Sadly, he was declared deceased at the scene. The Stanislaus County Coroner’s Office has identified the decedent as 60-year-old Alberto Toscano of Newman.
The Chevrolet driver informed CHP traffic investigators that his visibility was limited due to the sunlight at the time of the wreck. He sustained minor injuries but declined medical care. Officials said the cause of the fatal crash is under investigation, and they will look into whether speed or distracted driving played a role in the farm accident.
Things Survivors Should Know About Wrongful Death Cases
The loss of a family member may be devastating for the family left behind to pick up the pieces. The sense of loss and grief for survivors may be compounded by anger and frustration, knowing that someone else is to blame. When this is the case, surviving family members may bring a wrongful death claim against the at-fault party for resulting losses. While a wrongful death action may not make up for the loss of a loved one, it may help survivors in coming to terms with their loss, knowing that the other party has been held financially accountable for their negligent actions.
In California, claims for fatal motor vehicle accidents are generally filed against insurance companies representing negligent drivers. While we may expect insurers to do the right thing and fairly compensate families for the unimaginable harms they have experienced, that is not always the case. Insurance carriers will use any defense tactic possible to get out of paying families who have lost loved ones in crashes. This is often done to protect the insurance company and its bottom line.
Defense counsel, retained by insurers, often dispute liability for the incident and hire experts to help in proving that. What is most unfortunate is that such situations may also occur in first-party insurance claims surviving family members bring against their policies for uninsured and underinsured motorist coverage. It is in the best interest of survivors to retain an attorney immediately after a fatal car accident. Unlike insurance companies, wrongful death lawyers want to help families get answers to all their questions and hold the other individual or entity responsible for their wrongdoing. How Can an Attorney Help My Family?
A wrongful death claim may be challenging to handle. Such cases require extensive investigation of the circumstances and facts of the fatal incident. They also require experience in handling negotiations with difficult insurance companies and defense counsel.
More than anything, successful cases help provide a sense of closure for survivors and serving as a warning to the community that such conduct will not be tolerated. However, they require the experience, skills, and resources a wrongful death attorney may have.
