Two-Vehicle Collisions
There are many different types of two-vehicle collisions:
- Rear-end collisions: This is one of the most common types of traffic accidents. It is due to a sudden deceleration of the lead vehicle or driver distraction. Tailgating is also a factor in this type of two-vehicle accident. Cervical sprain or whiplash is a frequent injury that affects the soft tissues of the neck and upper back. The driver to the rear is usually considered liable for the accident.
- Sideswipe accidents: This type of accident usually occurs when two parallel vehicles touch one another. Damages are generally minor, as are injuries.
- T-bone accidents: This accident is basically a side-impact crash and can result in grave injuries. This is due to the lack of side safety features on many vehicles.
- Rollovers: A two-vehicle collision can rapidly turn into a rollover. The involved vehicle will either flip onto its roof or side. A Crushed roof is a major hazard. In such cases, the roof is unable to withstand the weight of the vehicle and pushes down into the passenger compartment. This usually results in serious injuries or deaths.
- Head-on collisions: This does not happen as often as other types of accidents, yet the fatality rate is high. That is because the impact is composed of the weight and speed of both vehicles. It often happens on rural roads lacking a medium. Drunk or distracted drivers may weave out into the adjacent lane into oncoming traffic.
Liability for Two-Vehicle Accidents
Liability for two-vehicle accidents is commonly the result of driver error. In all cases, this involves negligence, whether intentional or accidental. Determining negligence depends on the following factors:
- The driver owed a duty of care to the injured person.
- The driver breached this duty.
- This behavior caused the accident.
- An individual was injured because of the driver’s error.
- The injury resulted in financial hardship.
What an Injury Lawyer Can Do to Help
In any accident, proving negligence is the first step since without it, the case is unlikely to proceed. In order to do this, evidence usually must be presented that proves negligence occurred. At our firm, we begin by sending our investigative team to the accident site. Once they arrive, the investigators search for tell-tale clues as to why and how the accident occurred. They employ accident reconstruction techniques to assign liability and obtain information from witnesses. Investigators also obtain traffic surveillance camera footage as well as that from nearby businesses and homes that show how the accident happened. In addition, police reports are reviewed for errors since they are widely used in negotiations with insurers and in court. Once all the information has been gathered, the investigative team releases it to our lawyers, who use it to build a robust case for our client.
