A preliminary report by the California Highway Patrol (CHP) indicated that the head-on collision involved a 2015 Acura sedan and a 2016 Toyota pickup truck. The Toyota driver, a 64-year-old Sonora man, allegedly veered over the double-yellow lines and collided head-on with the Acura.

Authorities said that the Toyota driver was uninjured while the Acura driver was transported via air ambulance to Doctor’s Medical Center in Modesto for treatment of serious injuries. A recent update on the case revealed that the patient, 27-year-old Rebekah Gall of Oakdale, succumbed to their injuries on Friday night, just three days after the crash.

The press release by CHP traffic officers also revealed that the Toyota driver was determined to be under the influence of alcohol at the time of the incident. He was arrested on suspicion of felony DUI with a BAC of 0.08 or more and felony DUI. Officials also said that the Toyota driver was a retired sergeant with the Pleasanton Police Department (Pleasanton PD).

Fatal Car Accidents and Wrongful Death Claims

When a family has lost a loved one in a motor vehicle accident in California, it is essential for survivors to understand when a wrongful death action is appropriate and which relatives have grounds to bring forth a claim. Under the California Code of Civil Procedure Section 377.60, the surviving family members that have priority when it comes to bringing a wrongful death action may include the decedent’s spouse, domestic partner, or children. If such family members are non-existent, others may be eligible to bring a case forward as outlined in CCP 377.60.

A wrongful death claim is intended to make survivors whole again in the form of financial compensation. This represents actual and future losses that the surviving family members of the deceased have and will reasonably suffer in the future. Recoverable economic and non-economic damages may include end-of-life medical expenses, funeral service costs, loss of future earnings, mental anguish, loss of care and companionship, and more. In cases where a loved one lost their life in an auto accident caused by a driver whose actions were particularly egregious, like DUI or excessive speeding, punitive damages may be sought from that party as a way of punishing them for the harm their actions have inflicted upon survivors.
