What Types of Damages are Available in a Merced Hit and Run Crash Case?
Damages in a personal injury claim refer to any financial or intangible losses from a motor vehicle accident that can be compensated. Economic damages include monetary losses such as past and future medical treatment and expenses, lost income, loss of future earning potential due to permanent disability, and property damage. Non-economic damages take into consideration the mental anguish, pain and suffering, loss of consortium, and anything else that may lower an individual’s quality of life from injuries suffered in a car accident. Economic damages are generally easier to calculate because they can be determined and proven through receipts and other forms of physical evidence. However, non-economic damages are often challenging to quantify since they are intended to compensate an injured person for the physical pain and emotional suffering their accident-related injuries have brought upon them. These differ in value from case to case. While no amount of money can undo all the harm an auto crash has caused, it can help an injured party and their family cover expenses and move forward in their situation. Statute of Limitations for a Personal Injury Lawsuit in California
There is a specific amount of time for an injured party to bring a personal injury claim. In California, there is a two-year statute of limitations on this type of case. This means a personal injury lawsuit must be filed within two years of the date of a car accident if a settlement cannot be reached with the other driver’s insurance company. If a person injured in a car accident waits longer than the filing deadline, their case may be dismissed by the court, and they may lose the right to seek personal injury damages. That is why it is essential to work with an experienced injury lawyer. An attorney can work diligently to ensure all filing deadlines and criteria are met in your personal injury accident case, so your right to full and fair compensation are protected.
