Damages Available in a Personal Injury Claim for a Car Accident
If all the necessary elements of negligence for a personal injury claim have been met and liability has been established on the part of the at-fault party, you may be entitled to compensation for your damages in the form of a jury verdict or insurance settlement. An award won for a personal injury case may include economic and noneconomic damages you and your family have suffered as a result of your trauma, such as:
- Medical Expenses: Any past and future medical treatment related to the traffic collision is recoverable. This includes any ambulance rides, hospitalization, therapies, medications, or medical supplies required for the treatment of your injuries.
- Lost Wages: Recovery for wage loss may be available in a personal injury case. This may help cover any shifts missed at work due to medical care related to your injury. If permanent disability occurred as a result of a car accident, then a loss of future wages may be claimed to cover the remainder of your working years. An economist may need to be retained by your Tracy personal injury lawyer to help calculate the true value of your future wage loss.
- Pain and Suffering: California law allows injured people to seek compensation for their intangible losses in addition to mental anguish, physical discomfort, loss of consortium, and loss of quality of life.

What is the Statute of Limitations on a Personal Injury Lawsuit?
In personal injury claims, time is of the essence. Each case must follow the statute of limitations, the time in which a claim can be filed with the courts. Under the California Code of Civil Procedure Section 335.1, a personal injury claim must be filed within two years from the date of a car accident. Since evidence can be lost or destroyed, and witnesses can forget what they saw, it is best to work with an experienced car accident lawyer in Tracy. An experienced injury lawyer can collect critical evidence immediately and ensure all statutory deadlines applicable to your claim are met while you focus on recovering from your injuries.
