What is Involved in the Wrongful Death Claims Process?
When a family loses a loved one in an auto accident due to another party’s negligence or recklessness, no amount of compensation can help survivors overcome the devastation and pain they are experiencing. However, taking legal action through a wrongful death claim may help surviving family members seek justice and a sense of closure by holding the at-fault party accountable. The types of compensation eligible survivors may receive come in the form of non-economic and economic damages. This may include funeral costs, loss of earnings, mental anguish, and other associated losses.
After a tragic loss, it is understandable that surviving family members need time to grieve and focus on their future. Unfortunately, there is a strict deadline that survivors must follow to file a case in civil court if a settlement is not reached with the other party within the time period. In California, the statute of limitations is two years in wrongful death cases. If the family waits beyond two years to file, the court may dismiss the case. This may result in survivors losing the right to recover damages for the loss of their loved one. As such, it is best to contact a California wrongful death lawyer immediately.

What Influences a Wrongful Death Case and Its Value?
The amount of compensation surviving family members may seek in a claim of wrongful death may depend on various facts and circumstances. These include the decedent’s age, overall health, occupation, education, future earning potential, total financial loss resulting from the fatal incident and loss of life, amount of liability coverage available, and more. Evidence in the case must be clear and compelling to demonstrate liability and damages. These include police reports, eyewitness statements, expert testimony, and more.
