One Killed in Stanislaus County Head-On Collision

At least one person was killed after a head-on collision in Stanislaus County on the afternoon of January 9, 2020. The car wreck occurred around 12:14 p.m. at the intersection of West and East Stanislaus Roads and Highway 33, just northwest of Westley and Grayson. The accident involved three vehicles identified as a sedan, an SUV, and a big rig. According to the California Highway Patrol (CHP), at least one party was pinned in a vehicle, and a coroner was called to the scene of the truck accident. Officials have not yet identified the decedent due to pending notification of family members.

How Long Do You Have to File for Wrongful Death?

There is a specific time limit for which a wrongful death lawsuit must be filed in California. This deadline is known as the statute of limitations, which is two years from the date of a fatal accident. When a government entity is to blame for a loved one’s wrongful death, such as a road defect, a notice of claim must be filed within six months or 180 days from the time of the incident. This is by California Government Code 911.2. If neither of the deadlines mentioned above is met, the case may be dismissed by the court, and the family may lose the right to recover wrongful death damages.

Who Can Bring a Wrongful Death Case in California?

A wrongful death claim in California may be filed on behalf of a decedent’s surviving spouse, domestic partner, or children. If such parties are no longer alive, other relatives of the deceased may be eligible to file for wrongful death benefits.
