One Killed in Sutter County Head-On Collision
One person was killed, and another was critically injured in a Sutter County head-on collision on August 4, 2019. The car accident occurred along Highway 99 at Messick Road, just south of Yuba City. According to the California Highway Patrol (CHP), a person driving a silver Infiniti sedan was headed northbound in the left lane of Highway 99. For unknown reasons, the Infiniti driver was involved in a head-on collision with an SUV. The impact of the crash caused both vehicles to catch fire, officials said. Each car carried one occupant. The SUV motorist was taken out of the car by a Good Samaritan at the scene. First responders transported the driver of the SUV to the hospital for treatment of serious injuries. Sadly, the driver in the Infiniti passed away at the scene. Authorities have withheld the identity of the Infiniti driver until their family has been notified. Our thoughts and prayers go out to those who have lost a loved one in this tragic collision.
Loss of a Loved One in a Sutter County Head-On Collision
Whenever a loved one passes away, it may be challenging to know where to begin the process of moving forward and grieving. The loss can be even more so devastating when it was caused by the negligence of another. When this happens, the family of the decedent may file a wrongful death claim against the person responsible for their loved one’s unexpected passing. These types of cases are generally covered by insurance companies. They are intended to compensate families for the financial and intangible harms they have suffered.
What Can a Family Recover in a Wrongful Death Claim?
A wrongful death case seeks to help the decedent’s family with compensation to cover economic and noneconomic damages incurred. These include:
- Costs associated with a loved one’s funeral and burial services
- Expenses for medical care received by the deceased before his or her passing, which is recoverable through a survival action
- Loss of a loved one’s affection, society, and moral support
- Loss of parental guidance for surviving children
- Lost inheritance, income, and benefits that would have been provided by the deceased to the family
- The reasonable value of household services that the decedent used to provide
Who is Entitled to Wrongful Death Benefits?
Under California Code of Civil Procedure Section 335.1, the surviving children, spouse, or domestic partner of the deceased can bring a claim for wrongful death. However, there may be exceptions if such parties do not exist. In these circumstances, the putative spouse, stepchildren, or parents of the deceased may be able to bring a wrongful death case. For more details on who can bring a wrongful death action, watch the below video.
