Motorcyclist Fatality Accident Occurred at Madison Avenue Intersection
The Sacramento County Coroner’s Office has released the name of a motorcyclist who died in a fatality accident on August 28. The man who died in the collision was Izaiah Rysz Fitzhugh, a 21-year-old Fair Oaks resident. The accident occurred along Madison Avenue at Blue Oak Drive around 11:17 a.m. and was reported by the California Highway Patrol (CHP).
Investigation Ongoing in Motorcyclist Fatality Accident
Authorities reported that the motorcyclist was going east along Madison at high speed when he was struck by a GMC Yukon, which was turning left. The Yukon was carrying a woman and several minors. The motorcyclist was ejected from the bike in the collision and perished due to the trauma. The three people riding in the Yukon were uninjured. The accident is being investigated by the CHP traffic collision unit.
Liability in a Motorcycle Crash
Liability depends on the evidence at the scene and witness statements about the fatal accident. Sometimes, both parties can be culpable. For instance, if a motorcyclist behaves recklessly when hit by a vehicle making a turn without a clear path, the court may assign a percentage of fault to both parties.
This is called comparative negligence. For example, if someone was 50 percent at fault, the other party could only collect half of the damages they suffered.
Intersections and a Fatality Accident
Intersections are dangerous, particularly for motorcyclists, for various reasons, including visibility and poor judgment. Motorists often blame hitting a biker because they did not see them. While this may be because of a lack of expectation, it is often due to carelessness when the motorist fails to appreciate the speed at which the motorcyclist travels. The complexity of the intersection adds to the issue.
Other reasons are:
- Blind spots: Motor vehicles may not see the motorcycle when changing lanes. In California, bikers can ride between lanes at certain speeds.
- Distracted driving occurs when the motorist focuses not on the road ahead but on other things.
- Risky actions: Motorists may make risky maneuvers in an interaction that increases the risk of a fatality accident, such as running a red light.
- Road conditions: Due to heavy traffic, intersections are prone to bad road conditions. These conditions include oil deposits, slick surfaces in inclement weather, leaves or uneven surfaces.
Wrongful Death Lawsuit
When someone dies in a fatality accident, the family can file a wrongful death lawsuit against the at-fault party with the help of an injury lawyer. Family members file this type of lawsuit and address the loss they face after their loved one’s demise. While it will never erase their grief, it can provide a sense of justice and monetary damages the family faces.
Some damages a wrongful death lawsuit covers are the following:
- Funeral and burial costs
- Medical costs before the descendant’s demise in a survival action
- Loss of love, support, and intimacy by a spouse
- Loss of inheritance
