Loss of a Loved One in a Tragic Accident
Losing a close relative is one of the most devastating things to cope with in life, particularly if it were the result of an accident that could have been prevented. If you lost a member of your family in an accident, an experienced Stockton wrongful death attorney may assist you in all legal matters related to the tragic loss and representing your family’s interests against negligent parties.
Under the California Code of Civil Procedure Section 377.60, surviving spouses, domestic partners, and children are granted priority for recovering compensation in a wrongful death case. This is followed by stepchildren, parents, putative spouses, and children of the putative spouse if no children or a spouse are present. Like other cases, these claims must be filed within the time limit known as the statute of limitations, which is two years from the date of the fatal accident to be admissible in court. If a lawsuit is filed in civil court beyond the deadline, the case may be dismissed, and survivors may lose the right to recovery of damages incurred.
Knowing where to start can be stressful and overwhelming, to say the least. Fortunately, an experienced attorney can help you navigate through the legal process and help you seek justice and compensation for your loss. For details on how to find the best attorney for your case, watch this video.
Does Insurance Cover Wrongful Death Pedestrian Accident Cases?
There are various ways in which a fatal pedestrian accident may occur, and each wrongful death case has its own unique set of circumstances and facts. It is a matter of understanding California law and knowing the best way to proceed with an insurance claim for a family to secure the financial recovery they may be entitled to.
In most pedestrian accident cases, the insurance company representing the negligent driver is generally liable for economic and non-economic damages incurred. If the driver was uninsured or carried insufficient liability coverage, survivors may bring a claim under their loved one’s uninsured/underinsured motorist coverage. If the deceased relative did not have UM/UIM coverage but lived with a relative who carries it, then a claim may also be brought under that policy.
Wrongful death cases can be challenging, and the assistance of an experienced attorney may be invaluable. It is essential for surviving family members to ensure their claim is in good hands so that their rights and best interests are protected.
