How Can a Wrongful Death Case Help Our Family?
A wrongful death claim in California is intended to provide surviving family members with financial compensation for specific intangible and financial losses they have experienced because of the unexpected death. Economic and non-economic damages may be sought through these cases that may include but are not limited to costs of medical treatment in connection to the deceased individual’s final injury, expenses for funeral and burial services, loss of household services provided by the loved one, lost future financial support the decedent would have provided to the family if not for the fatal pedestrian accident, and more. Punitive damages may also be sought to hold the at-fault party accountable for their egregious conduct like DUI and excessive speeding.
In wrongful death claims arising from fatal pedestrian accidents, there may be the issue of whether there is enough liability coverage to pay for resulting losses. This is especially true if the at-fault party was uninsured at the time of the incident. Under such circumstances, a family may have recourse through their insurance policy or that of their deceased loved one if they carry uninsured and underinsured motorist coverage. This type of protection is intended to pay for damages incurred up to the limits of the policy if it has been determined that the other driver has limited to no liability coverage. What is great about uninsured and underinsured motorist coverage is that it may extend protection to other members of a household so long as the policyholder did not list them as excluded members.
While a civil case may not undo the mental anguish you and your family have experienced nor bring a lost loved one back, a successful claim may provide you all with the sense of justice and financial compensation you all need to move forward. It is essential to retain legal counsel immediately as California generally allows two years from the date of the fatal incident to file a wrongful death case in civil court. If the deadline is not met nor an insurance settlement is accepted within this period, the case may be dismissed by the court, and the right to recovery of wrongful death damages may be lost.
