Pedestrian Injured in Intersection Accident on Fruitridge Avenue

A pedestrian accident on April 24 in Sacramento caused an injury to the walker, who was transported to a hospital for treatment. The pedestrian was struck in the Lemon Hills area at the intersection of Fruitridge Avenue and Martin Luther King, Jr. Boulevard shortly before midnight. When officers with the Sacramento Police Department and Sacramento Fire Department arrived, they discovered that the pedestrian had been struck and injured by a Chrysler 300, which had major damage to the windshield.

The driver remained at the accident scene and was cooperating with the officers investigating the crash. Both directions of westbound Fruitridge Avenue and southbound Martin Luther King Jr. Boulevard were closed while the investigation was conducted into how the accident happened.

Negligence in a Pedestrian Accident

Although there are times when a pedestrian is at fault in an accident, they are often caused by negligent motorists as well. By investigating a pedestrian accident, it can be discovered whether negligence by the motorist was the cause of the walker’s injury. Some ways in which a motorist can be negligent include:

  • Driving through a red light or stop sign at an intersection
  • Speeding and being unable to stop in time to avoid striking a pedestrian
  • Distracted driving such as texting or talking on a cellphone
  • Drunk or drugged driving, which affects judgment, vision and reflexes
  • Turning at an intersection without looking for walkers

Recoverable Damages in a Pedestrian Accident Injury

The following are damages that can be recovered when a pedestrian has been injured through someone else’s negligence:

  • All medical expenses associated with the accident: This includes ambulance, hospitalization, tests, specialists, rehabilitation and prescription medicines. Costs are also covered if the injury symptoms are expected to continue into the future.
  • Lost wages: The amount lost from being unable to work is recoverable, as well as regular bonuses and other monies the injured person would have normally earned. If the injured party can no longer perform their job and have to be demoted, the difference in wages is recoverable.
  • Pain and suffering: This includes the loss of consortium, affection, and love normally enjoyed by the injured person.

Investigation of an Accident

A pedestrian who has been injured by a negligent driver should not have to pay the costs associated with the accident. With the help of an experienced Sacramento personal injury attorney, the injured person can place a claim for compensation to pay those expenses. By conducting a thorough investigation, strong evidence can be gathered to support your claim. What our investigators do includes the following:

  • Ensure that the police report is correct and without errors
  • Interview the witnesses to the collision for supporting statements
  • Look for cameras from traffic lights and businesses that may have the accident captured on tape
  • Perform accident reconstruction
  • Gather road evidence such as tread marks and debris
  • Look for road damage caused by government negligence that might have contributed to the crash

Our lawyers use the compiled evidence to build a strong case favoring our client. It can be used in presenting the case in court or when negotiating with an insurance company.
