Marconi Avenue Intersection Location of Critical Injuries to Pedestrian
A pedestrian accident in North Sacramento on March 13 left the walker with critical injuries after being struck by a car. The collision occurred around 7:00 p.m. at the intersection of Marconi Avenue and Auburn Boulevard at the Capital City Freeway junction. Emergency responders with the Sacramento Fire Department transported the injured pedestrian to a hospital, where his condition was described as critical.
Pedestrian Accident Being Investigated
It was reported by the California Highway Patrol (CHP) that the driver of the vehicle that hit the pedestrian remained at the accident scene and was cooperating with the investigation. The CHP said that neither alcohol nor drugs were suspected as a factor in the collision.
Causes of a Pedestrian Accident
Despite community efforts at keeping walkers safe, the number of pedestrians injured and killed in California has grown considerably over the years. Some of the reasons this happens are listed below:
- Distracted driving: Rather than keeping their focus on the road, many drivers try to multitask when motoring. This includes playing with the radio, looking at the GPS, texting, placing or answering a phone call, and talking to other occupants in the vehicle. This lack of focus results in a pedestrian accident almost daily.
- Intoxicated drivers: Drunk drivers are notorious for speeding through intersections without stopping and other negligent actions. This behavior is capable of causing a pedestrian accident, especially at a crowded intersection.
- Speeding: Driving fast is a major factor in a pedestrian accident. Not only does it cause a collision with a pedestrian, but the speed determines the extent of injuries. For example, impact at 40 mph usually causes serious injuries or deaths. Alternately, striking a pedestrian at under 10 mph commonly causes less significant injuries.
- Weather conditions: Inclement weather makes it difficult to stop in time to avoid an accident with a pedestrian. A remedy for this includes motorists who drive below the speed limit, taking into account weather conditions.
- Failing to yield: This is a primary rule for drivers when they encounter a pedestrian. It is true in crosswalks, but it is also valid in other instances. Not yielding to a walker is a major cause of a pedestrian accident.
- Left-hand turns: Due to the congestion found in most intersections, drivers need to be aware of other motorists, bicyclists, and pedestrians crossing through when attempting to make a left-hand turn. Oftentimes, the driver will argue that they did not see the pedestrian. Lack of conspicuity is not a valid argument in the driver’s defense.
- Negligent backing: Drivers backing out of a driveway or parking space must take extra care and look for pedestrians. Children are most vulnerable since they are not easily seen behind a vehicle.
Investigating a Pedestrian Accident
At our law firm, our investigators are a crucial element in successfully resolving a case since without evidence of liability, the case may not proceed. To heed this need, we dispatch our investigative team to the accident site, where they look for clues as to why and how the accident happened. They perform accident reconstruction techniques that are instrumental in proving liability.
Beyond that, they interview witnesses to get a handle on what they saw when the pedestrian accident occurred. Our investigators also obtain video footage from surveillance cameras on traffic lights and businesses nearby. To assure accurate information, the investigators review police reports since they are commonly used in insurance negotiations and in court.
When all the data is accumulated, it is turned over to our legal team. Our injury lawyers use the data to construct a strong case for our client.
