What to Expect from a Wrongful Death Claim for a Pedestrian Accident
A wrongful death case requires clear and compelling evidence that the other side’s negligence contributed, in part or in whole, to a family member’s demise and that survivors suffered loss because of the fatal incident. This may include CHP traffic incident reports, video surveillance footage, statements from eyewitnesses to the crash, photos of the crash site, expert witness testimony, autopsy reports, and more. Keep in mind that evidence must be gathered and preserved immediately following the incident. Without evidence, it may be challenging to establish causation and damages in a civil case.
Successful lawsuits generally cover economic and non-economic damages for loss of household services, mental anguish, loss of financial support, funeral bills, loss of inheritance, medical expenses, loss of companionship, and more. Given the potential for significant losses and the at-fault party having minimal or no liability coverage, surviving family members may turn to the decedent’s auto insurance policy if they have uninsured and underinsured motorist protection to cover the remainder of non-economic and economic damages.
California law is specific on which surviving family members have grounds for a claim for damages. CCP 377.60 outlines which survivors have priority. This usually includes the deceased’s spouse, domestic partner, or child. When these relationships with the deceased do not exist, other relatives may be eligible to bring a claim for damages. Determine your eligibility by reaching out to an experienced California wrongful death attorney immediately. Keep in mind that you generally have up to two years to file a case in civil court. Failure to do so may lead to losing the right to seek damages.
