Things to Know About Wrongful Death Cases in California
California law allows surviving family members to seek financial recovery when a close relative suffers fatal injuries in an incident caused by another party’s carelessness or negligence. For a fatal pedestrian accident case, the family may file a claim against the motorist who caused the crash and their insurance company. If the at-fault party does not have adequate auto insurance limits or no coverage, the family may have other options. Uninsured and underinsured motorist protection may pay for losses from a collision caused by a driver with insufficient insurance or no liability coverage.
The surviving spouse, domestic partner, and children of the deceased have priority under California law to file a wrongful death case against the opposing party. This is outlined in CCP 377.60. If the decedent is not survived by these family members, then the deceased’s parents, stepchildren, putative spouse, and other relatives who depended on them for financial support may be eligible. An experienced California wrongful death attorney can review the case’s specifics to determine if a family member is eligible to bring a claim for damages.
Eligible surviving family members may seek compensation for economic and non-economic damages. This may include funeral service costs, mental anguish, loss of inheritance, financial support, and benefits the decedent earned through employment. The statute of limitations for wrongful death cases is two years from the date of loss, with some exceptions that may apply. It is best to consult a lawyer with experience handling wrongful death cases to determine the appropriate deadline to file a claim.
