Fatal Accidents and Claims for Wrongful Death

When a fatal Stockton fleeing driver accident occurs in Stockton due to a negligent driver, the victim’s family may be entitled to file a wrongful death claim to seek compensation. An experienced accident attorney can help identify the responsible party and determine whether their negligence caused the death. Usually, the surviving spouse and children file the wrongful death claim. In the absence of a spouse or children, other family members, such as parents or siblings, may initiate the claim.

Finding the Driver Who Fled in the Stockton Fleeing Driver Accident

Our law firm is experienced in locating the motorist involved in a Stockton fleeing driver accident. We check the police report, interview witnesses, collect evidence at the scene, and examine nearby surveillance cameras. We also check body shops for vehicles with appropriate damage that have been brought in for repair. It is our goal to locate fleeing drivers so they can be held responsible for their actions.

Compensation Recoverable in a Wrongful Death Claim

Compensation commonly recovered in a wrongful death claim after the death of a pedestrian may include the following:

  • Funeral and burial or cremation expenses for the deceased
  • Lost wages the deceased would have earned until retirement
  • Loss of consortium, love, and affection for the surviving spouse
  • Loss of nurturing and affection for the children
  • Loss of household support and assistance

If the Driver Cannot Be Located

If the driver who fled the scene cannot be located, the family may use an uninsured/underinsured auto policy to recover compensation, which can help ease their financial burden. The rates do not change when using this policy. An accident lawyer can help by negotiating on their behalf to reach a fair settlement.
