Fatality Accident at 3rd and Mission Caused by Two-Vehicle Crash
Two pedestrian fatalities occurred in San Francisco on May 22, and another person was injured after being struck by a taxi involved in a collision with another vehicle. The taxi then struck the two women and ended up on the sidewalk. The San Francisco Police Department reported that the accident happened near the Yerba Buena Center for the Arts at the 3rd Street and Mission intersection at about 4:32 p.m.
Two Florida Residents Killed in Collision Involving Taxi
The Medical Examiner’s Office released the names of the deceased pedestrians on May 23 as Mary Henderson, age 72, and Willa Henderson, age 31, both Vero Beach, Florida, residents. The other pedestrian who was struck, identified only as male, was hospitalized with injuries, and the taxi driver, but both are expected to survive.
Pedestrian Fatalities and Wrongful Death
When a pedestrian dies due to a negligent driver or other entity, the family may claim wrongful death. However, liability in an accident may be complicated, so enlisting the assistance of a wrongful death lawyer can ensure that all those who were negligent can be held responsible. For example, in the recent accident in San Francisco, the pedestrian fatalities resulted from a two-vehicle collision involving a taxi.
Determining Liability for Accidents Involving Pedestrians
First, who was at fault for that two-vehicle collision must be determined. Was it the taxi driver or the other motorist? It is possible that both were at fault if one was tailgating, for instance, and the other was driving distracted. These are determinations that can be solved by investigators with a law firm.
Ensuring That Government Negligence Wasn’t Involved
In another scenario, the accident might have occurred because the traffic lights malfunctioned, leading to the accident and the pedestrian fatalities. In this scenario, the government entity maintaining those traffic lights could be liable for the fatalities. In California, claims against a government entity must be filed within six months of the date the accident happened. Due to the complexity of the paperwork and various deadlines that must be met, using an injury lawyer to handle this can mean the difference in whether the case is resolved successfully or not.
Recovery of Damages in a Wrongful Death
Although it probably doesn’t occur to a grieving family that suddenly lost a loved one in an accident, they often realize how they will be impacted financially. In addition, they want justice for the loss of their loved one. By filing a wrongful death claim, the family can recover the following:
- The expenses for the loved one’s funeral services and burial can be recovered.
- Income the loved one would have earned until their retirement age can be recouped, including their pension, insurance, and other benefits.
- Loss of consortium and companionship can be recovered.
- The family’s children can recover compensation for the guidance and nurturing the deceased parent provided.
- Loss of inheritance is recoverable in some cases.
- Loss of the help the decedent provided around the home can be recovered, such as lawn care, childcare, and others.
