What Survivors Should Know About Wrongful Death Cases
When an individual’s demise occurs because of someone else’s carelessness or negligence, a wrongful death action can be filed against the opposing party. These matters aim to provide monetary relief to survivors who have experienced financial and emotional hardship due to the sudden loss of a family member. Establishing a case requires clear evidence demonstrating that the defendant’s negligent or reckless act caused the fatal incident resulting in death and that survivors have incurred financial and intangible losses as a result. A case generally must be filed no later than two years from the date of loss.
Some of the circumstances that often give rise to cases of wrongful death in California include motor vehicle collisions, product liability, premises liability, and more. Whether liability lies with an individual or entity, the surviving family members of the decedent may be entitled to financial compensation for the unexpected loss of a close relative. Damages in these cases can include mental anguish, loss of companionship, funeral and burial costs, loss of financial support, and more. Conversely, medical bills for the decedent’s final injuries may be recoverable through a survival action.
As there are various things that give rise to these matters, specific factors must be considered when determining whether a settlement agreement is fair and reasonable. This includes how the fatality occurred, who is responsible for the fatal incident, and whether the family has retained legal counsel. Wrongful death law in California may be challenging to navigate as a survivor coping with loss and grief. As such, surviving family members need an experienced attorney on their side to provide the diligent representation and compassionate support they deserve.
Importance of Working With an Experienced Attorney
Since every wrongful death matter is unique due to the facts and circumstances involved, it may take months or years to reach a resolution with the opposing party. This considers the various stages involved with filing a lawsuit in civil court, including an in-depth investigation into the fatal incident, discovery, negotiations, and trial if necessary. Before discussing a settlement with the insurance carrier, it is essential to consult with an experienced and knowledgeable attorney. The right lawyer will help you understand your options as a surviving family member in California.
