Accident Near North City Farms Causes Pedestrian Fatality

A pedestrian fatality that may have included a hit-and-run was reported on November 6 near the North City Farms area of Sacramento, which involved either one or two vehicles striking the person. The Sacramento Police Department reported that officers arrived at the accident site shortly after 7:00 a.m. at the intersection of 24th and Fruitridge Road. Upon arrival, they discovered a man who had been struck near that intersection. Fire personnel pronounced the pedestrian deceased at the accident scene.

Driver Stays at Scene but Authorities Think Second Motorist May Have Been Involved

Officers stated that the driver of a vehicle who struck the pedestrian remained at the accident scene and was cooperating with law enforcement in the investigation. However, officers think a second vehicle may have also struck the pedestrian and left the scene. No additional information was provided at this time on the possible second driver.

Investigation Closes Road and Rail Station for More than Five Hours

The road where the pedestrian fatality accident occurred remained closed down for over four hours as an investigation was conducted. In addition to the road closure, the fatal accident occurred near an area light rail station, which was closed down by Sacramento Regional Transit. While it remained closed, a bus bridged riders between the 47th Avenue and Sacramento City College stations to help them reach their destinations. The roadway reopened around 12:30 p.m.

Recovery of Damages Following a Pedestrian Fatality Caused by Negligence

Losing a loved one is tragic, and the family not only faces grief over that loss but possibly the financial repercussions, especially if the decedent contributed to their income. By filing a wrongful death claim, the family may be able to recover the damages that follow:

  • Recovery of damages includes the cost of the funeral and burial.
  • Income the decedent earned up to the time of retirement is recoverable, which includes pension, insurance, IRA contributions, bonuses, and other perks of the job.
  • Work that the deceased party performed around the home can be compensated. This can include tax preparation, child or lawn care, tending to the family’s vehicles, and others.
  • The surviving spouse can place a claim for loss of consortium, companionship, and moral support that the decedent provided.
  • Children in the family can claim loss of guidance, protection, and care provided by the decedent.
  • Loss of inheritance may be recoverable because the decedent will no longer be contributing to the estate, which would be inherited by survivors.
  • In cases where the individual lived for a time before dying, the family may file a survival action. A survival action is filed by the estate on behalf of the deceased person, which replaces the individual’s right to file a personal injury had they lived. Under a survival action, damages can be recovered by the estate that includes all the medical expenses incurred before the person’s death and recovery of damages for their pain and suffering.
  • Punitive damages may be requested by the family if the pedestrian fatality was caused by egregious negligence or an intentional act. Your injury lawyer can further explain whether your family can file for punitive damages.
