Walking in the Fast Lane on Highway 50 Causes Pedestrian Fatality
A pedestrian fatality accident occurred after a woman was struck by a vehicle while walking along Highway 50 on May 30. The collision occurred near the College Town neighborhood close to the exit for Howe Avenue around 4:30 a.m., according to the report by the California Highway Patrol (CHP). The police report stated the pedestrian had walked into the fast lane when she was hit. The driver of the vehicle pulled over and called authorities.
Eastbound Highway 50 Closed for Accident Investigation
All of Highway 50 eastbound lanes were shut down and traffic was diverted while CHP traffic investigators determined how the collision occurred. Although the lanes were open at about 7:15 a.m., congestion in the area continued for some time. Officials have recently identified the decedent as 69-year-old Sacramento resident Mary Karen May.
Wrongful Death Claim After a Pedestrian Fatality
A family who seeks compensation for wrongful death after a pedestrian fatality accident must present evidence. It is possible to be held liable for damages under California law if someone dies as a result of someone else’s negligence or wrongdoing. If a pedestrian is killed during a traffic collision as a result of an at-fault driver’s negligence, his or her family may be entitled to such compensation for their loss.
Recovering Evidence to Support a Wrongful Death
An injury attorney can investigate a pedestrian fatality traffic collision case to determine whether the evidence supports wrongful death claims. Documents such as police reports, witness statements, traffic surveillance videos and photographs of the accident scene should be collected. There are also expert witnesses who can testify as to the cause of death and the at-fault party’s negligence.
Contacting a Wrongful Death Lawyer
In order to make a successful claim, you should contact a California wrongful death lawyer immediately. To ensure that all aspects of your case are considered, a lawyer can help gather evidence and evaluate its strength. As well as learning what your legal rights are, you can also learn how to pursue a successful claim.
Recoverable Damages in a Wrongful Death Case
A California wrongful death lawsuit can recover compensation for a variety of damages, including:
- Recovering funeral and burial expenses is possible.
- Recovering the deceased’s wages until retirement age, pension and insurance benefits are possible.
- In the event of the death of a loved one, there may be a claim for loss of guidance, advice, love, protection and moral support.
- The surviving spouse may claim loss of consortium.
- There may have been household services the deceased provided, the cost of which is recoverable.
Wrongful death claims have a limited time period in which they can be filed. Close relatives, such as spouses and children, are the only people who can file a claim. An individual’s parents and siblings may be eligible to file a claim if he or she did not have a spouse or children.
