Pedestrian Fatality on Carpenter Road in Modesto

The California Highway Patrol (CHP) reported a pedestrian fatality on Carpenter Road in west Modesto on the night of Friday, January 15, 2021. Shortly before 10:50 p.m., emergency dispatchers received a report of a Modesto pedestrian accident on Carpenter Road in the vicinity of Maze Boulevard, or State Route 132.

According to the CHP traffic accident report, a 63-year-old Modesto man was driving a Toyota Camry south on Carpenter Road. The Toyota driver was traveling at approximately 45 mph when he noticed a female pedestrian in the road. He said he was unable to stop his vehicle in time to avoid crashing into the female pedestrian. Sadly, the woman suffered fatal injuries in the pedestrian accident. Her identity has not yet been released due to pending notification of family members.

Consequences of a Modesto Pedestrian Fatality

The city of Modesto is a great place for taking a walk. The unfortunate reality is that pedestrians share the road with motor vehicles, and collisions may sometimes occur. A pedestrian accident is often catastrophic or even fatal for the pedestrian because they have no form of protection to absorb the impact of the crash. As a result, pedestrians are often at a loss because of mounting medical expenses and the inability to work.

In the case of a fatal pedestrian accident, surviving family members are often left behind to pick up the pieces. No one deserves to pay for the damages a negligent driver has caused in either of these situations. If you have lost a loved one in a pedestrian accident, contact our Modesto personal injury lawyers for a free consultation and learn more about how our legal team can help you and your family today.

Types of Wrongful Death Compensation Available to Survivors

Whether or not surviving family members may be entitled to compensation for the loss of their loved one will depend upon the facts and circumstances of their wrongful death pedestrian accident case. If the driver who struck the close relative was at fault, survivors may be able to file a wrongful death claim against them and their insurance company. Also, California is a comparative fault state, meaning that if a pedestrian was partially at fault for the incident, the amount of compensation awarded to them would be reduced by the percentage of negligence assigned to them.

If you have lost a loved one in a fatal pedestrian accident, you and your family may be entitled to compensation for economic and non-economic damages, such as:

  • Medical bills for end-of-life care
  • Funeral and burial service expenses
  • Loss of the decedent’s care, protection, and guidance
  • Lost inheritance, benefits, and future earnings
  • Mental anguish and emotional trauma from the sudden loss of a loved one
