Pedestrian Suffered Moderate Injuries
An injured pedestrian was transported to a local hospital by emergency responders with the Sacramento Fire Department on June 29 following an accident. According to a representative with the Sacramento Police Department, the crash between a motor vehicle and the pedestrian happened around 12:15 in the morning along 16th Street between X Street and Broadway. The pedestrian was reported to have moderate injuries from the collision. Sixteenth Street was shut down while authorities investigated the cause of the crash. It is unknown at this time whether alcohol or drugs was a contributing factor.
Pedestrian and Motorist Responsibilities
Traffic collisions that result in injured pedestrians are often caused by errors. A pedestrian has the responsibility to cross the street at an intersection or other designated crossing and to look for motorists to stay safe. The driver should avoid traffic infractions such as speeding, which increases the risk of an injured pedestrian. This is because the time for the motorist to react and stop a vehicle is longer. Running a red light is a common problem, especially during the hours after dark because traffic is lighter and police presence is less apparent. The driver may have been out drinking or under the influence of drugs. Drunk driving is responsible for more than 10,000 fatalities every year and countless accidents that result in an injured pedestrian.
Roadway Hazards That Contribute to an Accident
Roadway hazards are a problem for both motorists and pedestrians. Non-functioning lights at an intersection, poor lighting, and foliage that obscures someone who is walking can lead to an injured pedestrian. In these cases, the government entity in charge of maintenance may be held liable for injuries. Because this is a specialized area of personal injury law with a much shorter time frame in which to file, it is important to contact a lawyer quickly. Evidence can be lost, covered up, or destroyed. This can affect the injured person’s ability to obtain fair compensation to pay their medical costs, lost wages, and for the pain and suffering they have endured.
How a Personal Injury Lawyer Helps
An experienced lawyer can help by reviewing the police report for inaccuracies and interviewing witnesses. The lawyer can also look for video footage of the vehicle, pedestrian, and accident when available from street cameras and those at nearby businesses. In addition, an accident reconstructionist can perform an investigation to find out whether the driver attempted to stop, was speeding and other important factors that can establish liability.
