Pedestrian Injury Accident at Rosemont Intersection
A pedestrian injury accident occurred on November 29 at the Rosemont intersection of Manlove Road and Rosewood Drive, south of Folsom Boulevard. The accident happened shortly after 9:00 in the morning and was caused when a white Toyota sedan struck the walker, according to the California Highway Patrol (CHP) report. However, no information was released on the name of the pedestrian or extent of injuries suffered in the crash.
Pedestrian Safety
With the increase in traffic over the years, crossing the street, even at a designated crosswalk, can be dangerous. This can cause a pedestrian injury accident resulting in the suffering and pain of injuries in addition to time away from work and mounting medical costs. It can affect the injured person financially as savings are drained away to pay for those costs. An experienced pedestrian accident lawyer can help by negotiating with the insurance company to pay fair damages or taking the case to civil court if necessary. In this way, the injured person can spend their convalescent time healing without the worry of a financial drain that adds to their stress.
How Drivers Contribute to a Pedestrian Accident
Some accidents are contributed by the pedestrian when they cross a street in the middle of the block, are distracted by music or texting to a friend and don’t notice a car in their path. Others are caused by drivers when they disobey traffic laws or aren’t cautious enough when crossing through an intersection. Some types of driver errors that can cause a pedestrian injury accident include:
- Running a red light or stop sign
- Making an illegal turn
- Rushing through a yellow light before it changes without looking first for pedestrians who are crossing
- Speeding, so the motorist does not have enough time to react and slow down or stop in time to prevent a pedestrian injury accident
- Texting or talking on a cell phone or other forms of distraction that can prevent a motorist from seeing a pedestrian
- Driving while too fatigued, which can affect a motorist’s alertness and reflexes in an emergency
- Driving while impaired by alcohol or illegal drugs
California Law on Negligence
Since California is a comparative fault state, this means that both individuals in an accident may be partly responsible in some cases, although not in all. For example, a pedestrian is crossing in the middle of a block and is struck by a motorist who is driving above the limit. In this case, the pedestrian may be said to be 30 percent at fault for the accident, while the driver is assigned 70 percent for speeding, which prevented them from stopping in time to avoid the collision. In the above example, the pedestrian would still be able to collect 70 percent of awarded damages. A seasoned personal injury lawyer understands the financial worry and stress caused by a pedestrian injury accident and can help by dealing with the insurance company or by presenting a strong case for compensation in civil court if necessary.
