Pedestrian Accident on College Oak Drive Results in Injuries
A pedestrian injury accident occurred on January 24 in Sacramento when an individual on foot was struck by a car. The accident, which was reported by the California Highway Patrol (CHP), occurred around 6:10 at night along College Oak Drive, which is between Chippendale Drive and Whisper Lane. The vehicle involved was a Jeep Cherokee, and the driver remained at the scene while an investigation into the pedestrian injury accident was conducted. After being assessed by first responders with the Sacramento Fire Department, the injured pedestrian was transported to Mercy San Juan Medical Center with undescribed injuries.
Injuries Following a Pedestrian Accident
Pedestrians are vulnerable to severe injuries when they are involved in an accident with a motor vehicle. This can lead to long hospitalization, high medical bills, lost time at work, and the pain and suffering that goes along with it. When negligence by a driver was the cause, the injured pedestrian may place a compensation claim to recover those costs.
Over the years, my law firm, with its experienced injury attorneys, has helped many people recover damages. We strongly believe that being injured is bad enough without having to bear the financial brunt of that trauma.
Causes of a Pedestrian Injury Accident
Although some pedestrian accidents are the fault of the walker from stepping off a curb without looking or not using a crosswalk, most are caused by negligent motorists. Some of the reasons these accidents occur are as follows:
- The crosswalk has a malfunctioning signal, or the timing is off. In addition, overhanging tree branches may obscure the pedestrian’s view of oncoming traffic. The government entity charged with maintaining the crosswalk and surrounding area may be held liable in these cases.
- The driver is speeding or driving recklessly and does not stop at an intersection. This type of negligent behavior can lead to a pedestrian injury accident.
- A distracted driver is talking on their cell phone, texting, or performing some other activity that takes their eyes from the road. This is another activity that can cause a pedestrian injury accident.
- A driver who is either drunk or under the influence of drugs is behind the wheel of the car. Because someone who is impaired has their vision affected as well as their reflexes and sense of judgment, they are a danger to everyone on the road.
- Fatigue can be a problem with drivers who end up causing a pedestrian injury accident. Because they are not alert to what is going on around them and, in some cases, fall asleep at the wheel, they endanger everyone.
Investigating a Pedestrian Injury Accident
Our investigators collect and comb through all the evidence, which is necessary to support a client’s injury claim. They review the police report to ensure it has no mistakes and talk to any witnesses to the accident. In addition, the investigators perform accident reconstruction techniques, which show how the vehicle and the pedestrian were positioned before, during, and after the collision. This can help point toward fault and strengthen the client’s claim for compensation.
Traffic surveillance cameras and those at nearby businesses can provide strong evidence in a case. Our injury lawyers take the gathered evidence to construct a strong case for our client. In this way, they may be able to recover damages for their injuries, pain and suffering, and lost wages.
