Seeking Help Following a Pedestrian Accident
Pedestrians are among those who are the most vulnerable to injuries when involved in a car collision. Many times, the accident is caused by the driver of the vehicle for the following reasons, including:
- Distracted driving: The driver was texting, talking on a cell phone, or some other activity that took their eyes off the road. It only takes a few seconds of distracted driving to result in a pedestrian injury accident.
- Drunk/drugged driving: Using any substance that affects judgment, reflexes and vision can cause an accident.
- Fatigue: A driver who is overly tired can miss seeing a pedestrian in a crosswalk or fall asleep at the wheel. Those who are too tired to drive are commonly taking some type of medication, have undiagnosed sleep apnea or simply stayed up too late the previous night.
- Speeding: Speeding leads to many pedestrian injury accidents every year. When a driver is speeding, although they may see a pedestrian up ahead, they don’t have enough time to stop without striking them.
- Running a red light: Red light runners, along with other forms of reckless driving, are major causes of a pedestrian injury accident.
Pedestrian Accident Investigations
Evidence has to be collected following a pedestrian accident to provide support for the injured person’s claim. Our investigators are highly experienced in collecting that evidence. This includes, among other areas:
- The investigators look over the police report to make sure it’s correct.
- They talk to witnesses to see if anyone recorded the accident and can corroborate how it happened.
- Accident reconstruction is performed, which can help determine fault. It also includes taking photographs and noting areas such as dropped bits of metal from the vehicle and paint that came from the car or truck. This type of information can be matched to the vehicle. Forensic reconstruction of an accident is evidence that is widely accepted both by the court and by insurance companies.
- Signs of government negligence are checked by the investigators. Negligence such as obscured signage, poor lighting, and malfunctioning crossing lights may have contributed to the pedestrian injury accident. The government entity in charge of maintaining the intersection may be held liable in these cases. However, because the timeline for filing is much shorter than in other personal injury cases, it is important to contact a lawyer as soon as possible. Otherwise, if it is filed too late, the case will not be heard in court.
- The investigators conduct a search for road, business, and traffic cameras that might have captured the accident on film.
