Accident on Perry Avenue Causes Pedestrian Injury
A pedestrian injury occurred in South Sacramento on March 11 after the walker was struck by a vehicle. The collision happened around 7:50 a.m. along Perry Avenue between 23rd and 25th avenues, according to the California Highway Patrol (CHP) accident report. The pedestrian was transported by medics with the Sacramento Fire Department to UC Davis Medical Center. The extent of injuries to that person was not released. An investigation is underway to understand how the collision occurred.
Causes of a Pedestrian Injury Accident
Although some pedestrian accidents are caused by carelessness on the part of the walker, the majority happen because of a negligent driver. Some of the reasons these accidents involving negligence occur include:
- Running a red light: When a driver runs a red light or a stop sign, they can cause a pedestrian injury to a walker legally crossing the street.
- Making a right turn: A driver turning right may be concentrating so hard on possible traffic coming from the left that they fail to see a pedestrian in the crosswalk.
- Rear-end collisions: A speeding driver is going so fast they are unable to stop before striking the vehicle stopped ahead at a red light. This type of collision can push the front vehicle into the crosswalk, striking a pedestrian.
- Distracted driving: A distracted driver may be looking down at their cell phone and texting and fails to see a pedestrian stepping off the curb.
- Drunk driving: Drunk drivers commonly have problems tracking with their eyes, their reflexes are reduced and they can’t stay in their lane. This inability to drive safely can easily cause a pedestrian injury.
- Fatigued driving: Those who work swing shifts, stay up too late the night before or don’t get enough sleep may be too tired to drive. This can cause them to miss seeing a pedestrian in time to avoid hitting them.
- Roadway maintenance problems: When traffic lights don’t function properly, lighting overhead is poor and other roadway problems exist, it can lead to a pedestrian injury accident. The government entity in charge of maintenance may be held liable. However, the statute of limitations is short, so seeking the help of an injury lawyer may be helpful to ensure paperwork is completely corrected and filed on time. The injured party has six months to file their claim initially. The government entity then has to respond within 45 days. If the government entity denies the claim, a lawsuit must be filed by the injured party within six months. If no response is received from the government entity, the injured person has up to two years to file a lawsuit.
