Pedestrian Killed Along Poorly Lit Road in Sacramento

I’m Ed Smith, a Sacramento truck accident lawyer. A suspected homeless person was killed August 8 in Sacramento after being struck by a tractor trailer.

I wish to extend my sympathy to the friends and family of the pedestrian who died in the accident.

What Happened

The collision occurred about 4:10 in the morning as the pedestrian was crossing Florin Perkins Road near 23rd Avenue. A tractor trailer, heading north on the road spotted a pedestrian in the middle who was crossing the road with many belongings. According to the Sacramento Police Department investigating the accident, the items included a bicycle and cart with mattress that were all connected together. It is unknown if the pedestrian was on foot and pushing the load or was riding the bicycle. The big rig struck the pedestrian, who perished from the collision. As of the time of this report, the name and age of the accident victim has not been released.

Possible Contributing Factors

The roadway was closed down from Fruitridge Road to 23rd Avenue due to the large field of debris from the accident and to conduct an investigation. A representative of the Sacramento police did report one factor that might have contributed to the accident. Because the location where the accident occurred is industrial, the road is dark except at major intersections. For this reason, pedestrians need to make themselves visible to drivers and keep out of the roadway when it isn’t clear to cross, and drivers need to slow down and exercise more caution than they normally do.

Driver Cooperates With Investigation

The driver of the tractor trailer stopped following the accident and was cooperating with police. The police reported that the driver was not impaired and was not speeding when the crash occurred.

Sacramento Pedestrian Accidents

The California Office of Traffic Safety reported 193 injuries or deaths associated with pedestrian accidents in 2014 in Sacramento. Twenty-two persons were under the age of 15 and 25 were at least 65 years old. There was a total of 440 pedestrian injuries and deaths in Sacramento County that same year.

According to police who are investigating the above accident, the dark road may have contributed to the death of the pedestrian. Road safety comes under the jurisdiction of a government entity, whether it is city, county, state or federal. The City of Sacramento is responsible for the lights, or lack of them, where the pedestrian was killed. The timeline for filing a claim with a government entity is different than when filing other personal injury cases. Under the California Tort Claims Act, an injured person or family of the deceased person has six months or 180 days in which to file a claim.
