Wrongful Death Claim Following a Fatal Yuba City Traffic Accident
When a pedestrian or other person dies as a result of a negligent motorist or due to an intentional act, the family or estate representative of the deceased can file a wrongful death claim to recover compensation. In a Yuba City traffic accident involving a pedestrian, the evidence must show that the driver acted negligently, which led to the death of the walker. An injury accident lawyer’s job is to examine the case for fault, collect the evidence to support the wrongful death claim, negotiate with the insurance company, or take the case to civil court.
Filing Within the Statute of Limitations
A wrongful death claim must be filed within the California two-year statute of limitations. Usually, a settlement is reached with the at-fault party’s insurance company. However, if an agreement cannot be reached, it can be taken to civil court, where a jury will decide.
Wrongful Death Damages
Recoverable damages depend on factors such as occupation, age, and education. However, in many cases, the family can recover the following:
- Expenses for the funeral and burial
- Wages until retirement age, along with benefits
- The spouse may claim loss of consortium, affection, and love
- Children may recover compensation for their loss of parental guidance
- The family may recover compensation for the loss of household assistance the deceased provided
Underinsured/Uninsured Motorist Coverage
Another way in which our office can assist in collecting damages is through uninsured/underinsured motorist coverage. As an option, California drivers can purchase this type of coverage when they first elect to take auto insurance. Injuries or the fatality of the pedestrian will still be covered by this type of insurance if anyone in the household has this type of coverage. This will not affect insurance rates. Accidents that involve motor vehicles, bicycles, and pedestrians are covered.
