In the early hours of Thursday, September 28th, 2017, a pedestrian was struck and killed in the suburbs of Concord, California.
What Happened?
At approximately 5:45 a.m. on Thursday, September 28th, a 33-year old Concord resident was fatally struck by a 2010 Honda vehicle that was moving southbound on Kirker Pass Road, north of Clayton Road nearby Olive Drive. The female pedestrian’s identity has not been released to the public, due to the pending notification of family members. Police reported that the pedestrian was fatally struck while she was attempting to cross Kirker Pass Road outside from the designated crosswalks.
The accident was reported to the Concord Police Department, who quickly responded to the scene to discover that the pedestrian was severely hurt with traumatic injuries. First responders pronounced her dead.
The driver of the 2010 Honda, 52-year old Pittsburg woman, was unharmed by the collision. Authorities said the Pittsburg driver remained at the scene and has been cooperative in the ensuing investigation.
There were numerous reports of traffic delays following the pedestrian accident, as two lanes of Kirker Pass were closed down for investigation. The two Kirker Pass lanes were reopened after about 4 hours.
While the incident currently remains under investigation, authorities do not believe that alcohol or drugs were involved in the situation.
Information on Kirker Pass Road
During non-commute hours of the road, Kirker Pass road is a rather quiet road. However, Kirker Pass is a curvy path that extends outside of the residential areas of the Kirker Creek Apartments. Because of the silence that fills the street in the hours outside of rush hour traffic, many local Concord residents choose to jaywalk across streets as opposed to using the designated crosswalks.
What Happens When a Pedestrian is Not Within a Crosswalk?
Upon being hit by a motor vehicle, if a pedestrian is not within a crosswalk liability may still fall upon the driver. Drivers have a responsibility to avoid auto accidents and yield to all pedestrians in sight. Therefore, the driver in a pedestrian accident can still be held responsible if it is determined that he/she did not react in a reasonable way that could have potentially avoided the accident.
