Wrongful Death Claims in California
Families of pedestrians who have lost a loved one in California must provide evidence to support those claims. Deaths in a fatal pedestrian crash caused by someone’s negligence or wrongdoing are subject to California’s civil liability laws. A pedestrian’s family may be entitled to file a wrongful death claim if he or she dies as a result of a driver’s negligence.
Evidence Is Collected to Support the Claim
To file a successful wrongful death claim, you should contact an experienced California wrongful death lawyer after the fatal crash. A lawyer can assist in gathering evidence and evaluating its strength in a fatal pedestrian crash in order to ensure that all aspects of your case are considered. You can also find out what your legal rights are and how to pursue a successful claim from them.
Wrongful Death Lawsuits in California – What Can You Recover
Under California law, wrongful death actions can recover a variety of compensation, including:
- Recovering funeral and burial expenses is possible.
- Recovering the financial assistance the deceased provided, including their pension and insurance, is possible following a fatal pedestrian crash.
- Death may have left the surviving family members without guidance, advice, love, protection and moral support.
- Among the household services the deceased provided were cleaning and repairs, and these can be recouped.
- Punitive damages may be available to a party found at fault for acting recklessly or maliciously. This is an area you have to discuss with your attorney.
In California, wrongful death claims that arise from a fatal pedestrian crash must be filed within two years of the death. However, starting early is advisable because evidence in the case can disappear and witnesses are hard to locate. It is only close relatives, such as spouses and children who can make a claim for a deceased individual. Parents and siblings may be able to file a claim if the deceased had no spouse or children.
