Quad Driver Killed in Antioch Crash

The Antioch Police Department (Antioch PD) reported that a quad driver was killed after a motor vehicle crash in the City of Antioch on Wednesday, August 25, 2021. The incident occurred shortly after 5:30 a.m. in the area of Wilbur Lane and Viera Avenue.

Details on the Crash That Killed a Quad Driver in Antioch

Officials indicated that the report they received initially came in as a pedestrian accident. However, upon the arrival of Antioch PD officers, it was later determined that a vehicle was involved in a traffic collision with a mini quad. The driver of the quad, 39-year-old Ronald William Phelps II from Antioch and Oakley, was found with serious injuries and reported to be non-responsive. Sadly, Mr. Phelps was declared deceased at the scene of the ATV accident a short time later.

The fatal car accident prompted the closure of the intersection as police investigated the crash. The driver of the involved car stayed at the scene and was reported to be cooperative with investigators. No other details have yet been released regarding the incident.

What You Should Know About the Wrongful Death Claims Process

By bringing a wrongful death claim, the at-fault party may be held liable for the harm they have caused and the family may obtain closure and a sense of justice about the situation. With this type of civil case, surviving family members may receive financial compensation for economic and non-economic damages. This may include end-of-life medical bills, expenses for funeral and burial arrangements, loss of future financial support, loss of companionship, and other losses. Wrongful death actions serve the purpose of ensuring that survivors are not left in debt and help provide them the means they need for a more secure future.

Specific relatives may be entitled to financial compensation through a wrongful death case, as outlined in the California Code of Civil Procedure Section 377.60. This may include the surviving spouse, domestic partner, and children. Such parties have priority to bringing these types of cases. Other surviving family members may also be entitled to compensation so long as they can prove they were financially dependent on the decedent and that the parties mentioned previously are nonexistent.

Keep in mind that strict filing criteria and deadlines may apply to fatal motor vehicle accident cases. You generally have two years from the date of a fatal incident to file a lawsuit in civil court if you cannot reach a fair settlement with the insurance company. While this may seem like ample time, the truth is that evidence necessary in proving the case may be lost or destroyed over time. Other factors may also play a role in the claims process. The best way to determine whether you have the grounds to bring a claim is to reach out to an experienced Antioch wrongful death lawyer.
